3.1 How to renew expired work permit in Vietnam

In order to renew an expired work permit in Vietnam, the employer needs to follow the following 4 steps:

Step 1: Apply for Approval of Demand on using foreign workers

At least 35 to 75 days before the expiration date of the work permit, the employer must submit a request for approval of the need to employ foreign workers.

In this step, the employer needs to prepare the following documents:

  • Registration form for demand on using foreign workers (Form No. 02 under the Circular No. 18/2018/TT-BLĐTBXH)
  • Certified copy of business registration.

Then, all these documents will be submitted:

  • Directly at the Ministry of Labor, War Invalids and Social Affairs or Provincial People’s Committee; or online at http://dvc.vieclamvietnam.gov.vn.

Step 2: Prepare documents for renewing expired work permit:

The employer will need to prepare the following documents:

  • Request form for renewing work permit in Vietnam (Form No. 7);
  • Original health check and Original Vietnam Police Check;
  • Current work permit;
  • Certified copy of passport;
  • Approval certificate obtained in Step 1;
  • 02 4*6cm photos;

Step 3: Submit documents to renew work permit in Vietnam:

At least 5 to 45 days before the work permit expires, the employer must submit a dossier to the Department of Labor, War Invalids and Social Affairs where the work permit is issued.

Step 4: Get the new work permit

The employer must obtain a new work permit from the Department of Labor, War Invalids and Social Affairs within 03 working days from the date of submission of a complete and valid application file.

3.2 How to renew lost work permit in Vietnam:

This process may be more complicated then renewing an expired work permit in Vietnam as it involves more authorities. In case the foreigner loses his/her work permit in Vietnam or in any other country, he/she and the employer is required to follow the steps below:

Step 1: The foreigner shall report the case to the Police office at commune level or any competent authority in foreign country as provided for by the laws to get a Certification.

Step 2: The foreigner shall then report the case to his/her employer within 03 days of being aware of the fact that the work permit is lost.

Step 3: The employer shall, within 05 working days of being informed, prepared the required documents and submit them to the agency in charge of issuing the lost work permit to request a new work permit.

Step 4: The employer will get a new work permit within 03 working days after submitting full valid documents.
